FishCast AI is an independent startup project operated by an individual developer. References to "FishCast AI," "we," "us," and "our" mean the operator of the service.
These Terms of Service govern your access to and use of FishCast AI, including our website, forecast tools, saved spots, subscriptions, emails, and related services. By accessing or using FishCast AI, you agree to these Terms.
If you do not agree, do not use the service.
You must provide accurate information when creating or using an account. You are responsible for maintaining the security of your sign-in credentials and for activity that occurs under your account.
You may not share access in a way that bypasses plan limits, security controls, or fair-use expectations.
FishCast AI provides forecast-based fishing information, map tools, saved spots, trip planning features, and paid Pro features. Forecasts and map overlays are intended to help with planning, not to replace official marine forecasts, navigation tools, or local expertise.
We may add, remove, suspend, or modify features at any time, including free and paid features.
You agree not to:
You may save coordinates, notes, catches, and similar content through your account. You retain ownership of content you submit, but you grant FishCast AI a limited right to host, process, back up, and display that content solely to operate and improve the service.
You are responsible for ensuring your content is lawful and that sharing or storing a location does not violate access restrictions, private-property rules, or conservation requirements.
Paid plans are billed in advance through Stripe. By starting a paid subscription, you authorize recurring charges until you cancel.
Free accounts may be subject to feature, usage, or storage limits, including limits on saved spots. Those limits may change over time. FishCast AI may enforce such limits through the product and backend systems.
FishCast AI, including its design, software, branding, text, graphics, and compiled forecast presentation, is protected by intellectual property laws. Except for rights expressly granted in these Terms, we reserve all rights.
You may not copy, republish, distribute, or create derivative works from FishCast AI content except as allowed by law or with our written permission.
FishCast AI is provided on an "as is" and "as available" basis. We do not guarantee that forecasts, models, maps, or alerts will be accurate, complete, timely, uninterrupted, or fit for a particular purpose.
Conditions on the water can change quickly. You are solely responsible for boating, navigation, safety decisions, and compliance with local laws.
To the maximum extent permitted by law, FishCast AI and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business interruption arising from or related to your use of the service.
If applicable law does not allow a full limitation, our liability will be limited to the amount you paid to FishCast AI for the service during the 12 months before the event giving rise to the claim.
We may suspend or terminate access if you violate these Terms, create risk for the service or other users, fail to pay, or if we discontinue part of the service.
You may stop using FishCast AI at any time. Deleting your account or canceling a subscription does not automatically erase records we must retain for legal, billing, security, or fraud-prevention reasons.
We may update these Terms from time to time. When changes are material, we may provide notice through the product, by email, or by updating the date above. Continued use of FishCast AI after the effective date means you accept the updated Terms.
These Terms are governed by the laws of [Your State/Country of Residence], without regard to conflict-of-law principles.
Any dispute, claim, or controversy arising out of or relating to FishCast AI or these Terms will be resolved exclusively in the state or federal courts located in [Your Venue / State / Country], unless you choose to replace this clause before launch with an arbitration provision or another dispute-resolution framework approved by counsel.
If you intend to use arbitration, class-action waiver language, or consumer state-specific carve-outs, those should be inserted here before public launch.
